DEVELOPERS GRADED ROAD WITHOUT PERMIT

WESTERN ACCESS TO NISENE MARKS AND WEST RIDGE TRAIL WILL BE BLOCKED

In 1999, without County required grading permits, the developers graded and cut a road and home site on the Koch Property into the side of “Cardiac Hill” exposing the hillside to accelerated erosion and, in Nisene 2 Sea’s opinion, intentionally reducing critical portions of this hill to less than a 30 percent slope. The County red-tagged the site twice in response to the developer’s illegal grading activities.

In April 2001, the developer’s filed an application for a permit to grade more than 3000 cubic yards of soil to build a half mile long access road and driveway to the proposed home site on Cardiac Hill and for retroactive approval of their prior illegal grading. Action by the County concerning this permit is expected in late summer or early fall, 2001.

The developers have stated that once they begin building the home on the hill, they will fence the hill and block all public access to the Cabrillo Trail into The Forest of Nisene Marks State Park.

The Cabrillo Trail has been heavily used over the past decades by mountain bikers, runners, and hikers for western access into Nisene Marks and connections to the West Ridge Trail and Aptos Creek Road.
